KOTA KINABALU 22/10/2012: PACOS Trust is concerned with the newly established ‘Unit Pantas NCR’ (Native Customary Rights Fast Unit) system as it ignores the original concept of communal titles which should be about empowering communities to own and manage their own land as they see fit.

“Imagine if you and your neighbours share all the land in the housing estate you live in but the person who decides how the land is used, what is planted, or who can enter is decided by someone else who is not even from your housing estate and not familiar with your needs,” explained Anne Lasimbang, Executive Director of PACOS Trust.

Group seeks confirmation NCR land claims not entertained after 1930

KOTA KINABALU 27/09/2012: A group of natives is seeking confirmation from the State Attorney General and the Director of Sabah Lands and Surveys Department whether only native customary rights (NCR) claims that existed prior to 1930 would be entertained and determined.

Rambilin Bte AmbitRambilin Bte Ambit and 18 others through their counsel Datuk Kong Hong Ming, also seek confirmation whether the Department of Lands and Surveys Sabah entertains and determines NCR claims that existed after 1930.

They also want to know whether the NCR claims over land that had been alienated and issued with land titles by the department would be entertained and determined.

Kota Kinabalu September 26, 2012: Claims of customary land beyond the 1930 Land Ordinance will not be included under Native Customary Rights (NCR) but opened and treated as new land applications.

Land and Survey Department Director Datuk Osman Jamal said the limit of the NCR claim has been effected by Section 5, 6(1) and 88 of the Sabah Land Ordinance (SLO), whose meaning many parties have wrongly defined.

"In these three sections beginning December 13, 1930, Government land and reserves in this State will be handed its full rights to the government.

500 NATIVES STORM POLICE STATION

Sarawak police raided a village and detained five people whose names were not even in the report filed by a plantation company for allegedly burning a bridge.

KUCHING August 16, 2012: Some 500 angry villagers with their children from Melikin and nearby longhouses in Serian and Simunjan stormed the Serian police station yesterday, demanding the release of five individuals who were detained on Sunday night for allegedly causing a fire.

The villagers learnt that the five – Sanjan Ambol, 58, Musit Ngawing, 52, Tuai Rumah Nyalu Tampa, 55, Samad Junna, 41, and Singa Unsit, 58, – were to be charged at the Serian district court. All five were villagers from Melikin, Danau Melikin and Ensebang Plaie.

SOOK VILLAGERS CLAIM LOSING LAND TO PRIVATE FIRM

Sook villagers claim losing land to private firm

KENINGAU July 18, 2012: More than 500 people from a village in Sook claimed that they are in danger of losing their land to a private firm.

The villagers in Karamotoi Tengah/Angkawangan are also disappointed that their efforts for decades to apply for the title and native rights to the land were never approved, and now a private company appeared to have its rights to the land.

Rauni Gambar, 52, said residents in the area had already occupied the village in the 1930′s, where Malaysia was not even established.

KOTA MARUDU July 8, 2012: Minister of Science, Technology and Innovation Datuk Seri Panglima Dr Maximus Ongkili has urged the state government to double its current allocation to clear the backlog of land claims involving the natives and to allow for surveying to progress.

The Kota Marudu member of parliament said land ownership by rural natives is still hampered by insufficient funding to facilitate the surveying of areas which they applied for, including those which they had toiled on and native customary rights land.

“Sabahans have made their grouses known and heard relating to numerous native land claims yet to be processed after years of application, caused in the main by the lack of funds allocated to the Land and Survey Department specifically for conducting survey works,” he said.

KOTA KINABALU June 9, 2012: A senior practising lawyer yesterday asserted that Native Customary Rights (NCR) in Sabah has existed since time immemorial through the practice of customs or Adat by the natives.

“Despite the latest issue and statements by the State Attorney General (Sabah) and reiterated by senior deputy director of Land and Survey Department Sabah, my view is that no legislation can abolish such rights as such rights are also provided under the Sabah Land Ordinance and Forest Enactment,” said Ram Singh.

KUALA LUMPUR May 29, 2012: The Government should not appeal court decisions which favour and recognise the customary and land rights of the orang asli in the peninsula and indigenous people in Sabah and Sarawak.

PITAS 14th May, 2012: Para penduduk di dua perkampungan di sini iaitu Kg Mangkubau Darat dan Kampung Mantaya meminta Lembaga Pembangunan Perhutanan Sabah (Safoda) salah sebuah agensi kerajaan negeri tidak memasuki tanah yang mereka warisi dari nenek moyang mereka lagi sejak 1926.

Menurut Ketua Kampung yang juga jurucakap kedua-dua perkampungan itu, KK Mangundod Limuhau, Safoda sudah memasuki Tanah Adat (NCR) dan mereka sudahpun membuat bantahan rasmi terhadap penerokaan oleh agensi itu di kedua-dua kampung itu.

RANAU : A State Reform Party (Star) leader claimed that Sabah had lost every opportunities to Malaya and is losing even more as greed entrenched itself in the ruling elites who could easily find a matching capitalists.

Star's division head for Ranau, Jalibin Paidi, in a statement here said if one reflects long enough on this point, he or she would agree with his finding that Sabah had always been at the receiving end of Malayan mannouvres in the state, both politically and economically.

Take FELDA as example, he said, the Federal agency now has 300,000 acres of land in Lahad Datu and Kinabatangan. FELDA reaps around RM3 billion profits annually from its Sabah palm oil plantation. How many have we lost here for the last decades? he asked.

BANGGI April 28, 2012: Kemelut yang dihadapi ratusan pemohonan tanah di Kampung Timbang Dayang, kira-kira 10 kilometer dari Pekan Karakit, boleh dirungkaikan sekiranya kerajaan bertindak adil dengan memberi keutamaan kepada pihak yang membuat permohonan lebih awal demi kepentingan rakyat.

Jurucakap penduduk, Salmah Marail, berkata penduduk kampung yang mendiami kampung lebih 20 tahun lalu meminta supaya hak mereka sebagai rakyat dan pemohon tanah diberi keutamaan dan tidak diketepikan begitu saja.

KOTA KINABALU April 24, 2012: The Federal Land Development Authority (FELDA) should return 306,000 acres of land to the State after it reneged from its obligations to develop the land given to FELDA intended to serve the interest of the people.

Parti Keadilan Rakyat (PKR) president Datuk Seri Dr Wan Azizah Wan Ismail said the Sabah Barisan Nasional (BN) state government should be held responsible for its failure to protect the interest of the state and its people in the land settlement schemes undertaken by FELDA.

“As a result, the state government had sacrificed more than 306,000 acres of its prime agricultural land to the federal government, including thousands of acres of state land involving native customary land held by the local native communities such as in Tungku of Lahad Datu.

“As the government of the day, the BN should explain to the people and account for its failure and incompetence in allowing FELDA to deviate from its original objective after having allocated some 306,000 acres of State land to FELDA for land settlement schemes intended to serve the benefit of the people of Sabah,” she said at a press conference after an informal meeting with Sabah PKR leaders at Golden Seafood Restaurant in Tanjung Aru near here, yesterday.

Penampang Mac 11, 2012: Kadazandusun Cultural Association (KDCA) President Tan Sri Joseph Pairin Kitingan said the term "new Bumiputera" for people from outside the country is inaccurate because foreigners cannot become Bumiputera.

"If they are from abroad then they are not Bumiputera," he said at the closing of the Seminar on Understanding on the Rights and Customs of Sabah Natives at Hongkod Koisaan, Saturday.

The seminar organised by KDCA in collaboration with the Sabah Native Affairs Office (Pahaens) was in conjunction with the KDCA's 12th Triennial Delegates Conference scheduled for today (Sunday).

Responding to an earlier question from a participant who asked if there is any guarantee that "new Bumiputeras" would not get native status in Sabah, Pairin said it was not necessary for anybody to give the guarantee because it is already in the law.

"If you are not Malaysian you are not Bumiputera," he said.

The term "new Bumiputera" is said to refer to foreigners who somehow have acquired the necessary documents, notably Mykad.

Some are known to have entered forest reserves to open up lands and claim Native Customary Rights.

Its president, Hishammuddin Sulaiman, said city police chief Assistant Commissioner Ahmad Sofi Zakaria had given Tabah the green light for the event following a fruitful meeting with the security agency yesterday morning.

“They have given us positive feedback and views on this gathering, and this green light would be good for the people of Sabah as the event is solely to express the interest and views of the people,” he said in a press conference held at Sabah PAS office here yesterday.

Yesterday, PBS Vice President, Datuk Herbert Timbon Lagadan singled out the decision by SAPP President, Datuk Yong Teck Lee for creating FMU, saying there is merit and truth in the public perception that the creation of the FMU was a form of land abuse.

NCR: LAWYER TO SEEK COURT ORDERS

NCR: Lawyer to seek court orders

KOTA KINABALU Feb 15, 2012: A local lawyer will be seeking various orders from the High Court on the State Government’s stand pertaining to the provisions under the Sabah Land Ordinance (SLO) on the issue of Native Customary Rights (NCR).

Marcel Jude Joseph, a senior practicing lawyer, yesterday said he will be filing his application for a judicial review at the High Court’s registry here today of the recent statements made by the State Attorney-General Datuk Roderic Fernandez and Chief Minister Datuk Seri Musa Aman regarding the NCR issue.

He contended that the State Attorney-General’s statement as the representative of the State Government on the NCR would have serious implications, effects and repercussions, especially to the natives of Sabah.

Fernandez had on Thursday said among other things that there is no provision in the SLO for natives to go into occupation of land and claim NCR on it after 1930.

KOTA KINABALU Feb 14, 2012: Chairman of Sub-Committee for Natives Laws, Customs & Cultures of the Sabah Law Association (SLA) Datuk John Sikayun strongly disagreed with the Sabah State-Attorney General’s views that there is a cut-off date for Native Customary Rights (NCR) under the Sabah Land Ordinance.

“We note with deep regret the Sabah State-Attorney General (AG)’s views that Native Customary Rights [NCR] is valid only if occupied before 1930,” Sikayun said.
