NCR: Lawyer to seek court orders

KOTA KINABALU Feb 15, 2012: A local lawyer will be seeking various orders from the High Court on the State Government’s stand pertaining to the provisions under the Sabah Land Ordinance (SLO) on the issue of Native Customary Rights (NCR).

Marcel Jude Joseph, a senior practicing lawyer, yesterday said he will be filing his application for a judicial review at the High Court’s registry here today of the recent statements made by the State Attorney-General Datuk Roderic Fernandez and Chief Minister Datuk Seri Musa Aman regarding the NCR issue.

He contended that the State Attorney-General’s statement as the representative of the State Government on the NCR would have serious implications, effects and repercussions, especially to the natives of Sabah.

Fernandez had on Thursday said among other things that there is no provision in the SLO for natives to go into occupation of land and claim NCR on it after 1930.

He said a claimant for NCR today must show occupation of the land prior to 1931, and there is a cut-off time date for NCR under the SLO.

On Friday, Musa said the State Government takes the issue of NCR seriously and will look for the best solution that will result in a win-win situation for everyone.

He said he will bring the matter to the State Cabinet for in-depth discussion with fellow Cabinet members and will also invite Barisan Nasional (BN) component party leaders to discuss the issue, apart from seeking the opinion of the legal fraternity, especially experts on land matters.

Various quarters have reacted to the State Attorney-General’s statement, expressing their disagreement with the latter’s view and interpretation of the provisions governing the NCR accorded to the natives under the SLO, State and Federal Constitutions and decisions of the courts on the matter.

Yesterday, Marcel concurred with the disagreement voiced out by the various quarters, including the Sabah Law Association (SLA), contending that the statement made by the State Attorney-General was unconstitutional and in breach of Article 161(A)of the Federal Constitution and also Sections 13,14,15 and 16 of the SLO.

He said he will seek various orders from the court for the State Government to give due recognition and cognizance to all or any NCR claimed by applicants as in existence after the year 1930 and by qualified applicants who are unable to show occupation of the relevant lands prior to 1931.

He also will seek a declaration from the court that all or any NCR claimed by qualified applicants as in existence after the year 1930, and all or any NCR claimed by qualified applicants who are unable to show occupation of the relevant lands prior to 1931 are valid.

Consumer body hopes for best solution on NCR issue

“We fully believe that Datuk Seri Musa Aman as the chief executive of the Sabah state government of the day, will do his utmost best to protect the interest of the natives of this land. We don’t want the natives to become landless and homeless in their own land. Just look at the Orang Asli in Peninsular Malaysia, what had happened to them?

“If in the Peninsular, they have the ‘Ketuanan Melayu’which is protected, sensitive and untouchable, there is nothing wrong to have such in Sabah the ‘Ketuanan Anak Negeri’, the right of the indigenous people defended and protected by the country’s law,”
