UNIVERSITY STUDENTS FREE TO TAKE PART IN POLITICAL ACTIVITIES

Undergrads get green light

SERI KEMBANGAN: University students are free to take part in political activities now that Section 15(5)(a) of the Universities and University Colleges Act (UUCA) has become obsolete under the Court of Appeal's ruling on Monday.

image Deputy Higher Education Minister Datuk Saifuddin Abdullah said Section 15(5)(a) was effectively unconstitutional and violated the guarantee of freedom of speech as there was no order for a stay of execution on the ruling.

“Unless the Cabinet decides to appeal and the Federal Court overturns the ruling on Monday, the section is no longer valid,” Saifuddin told reporters after meeting three of the four Universiti Kebangsaan Malaysia (UKM) graduates who were plaintiffs in the case.

Saifuddin urged the Cabinet not to appeal the Court of Appeal's ruling.

“There are two possibilities here: If the Cabinet does not appeal, it would be a moral win for the Government as the sentiments of the people who want the law to be repealed are acknowledged.

If the Cabinet appeals and loses, then the Government will suffer a double blow,” Saifuddin said, adding that the matter might be brought up during the Cabinet meeting today.

He added that the focus now should be to amend the UUCA as it was only honourable that Section 15(5)(a) be deleted properly.

“We want to move on to be more progressive in tandem with the Government's Political Transformation Programme,” said Saifuddin.

Barisan Nasional Youth chief Khairy Jamaluddin said the court decision was binding and it was BN Youth's stand that the UUCA should be amended.

“It is a huge paradox that the majority of university students are of legal voting age and yet have to be politically stifled,” he said.

MCA vice-president Gan Ping Sieu said one of the agendas brought up by the BN Youth Lab previously was to amend the UUCA.

“It is illogical not to allow youth to talk about political and social issues if you are talking of youth empowerment and engagement with youth,” said the Deputy Youth and Sports Minister.

Deputy Prime Minister Tan Sri Muhyiddin Yassin said it was up to the Higher Education Ministry if it wanted to appeal the decision.

On Tuesday, Higher Education Minister Datuk Seri Mohamed Khaled Nordin said his ministry would consult the Cabinet on whether an appeal should be filed against the ruling.

“If Datuk Khaled wants some views on the matter, we can discuss it in the Cabinet today,” Muhyiddin added.

Universiti Malaya student representative council president Mohd Syahid Mohd Zaini said students should be given the freedom to speak up.

The abolition of the UUCA will open the way for students to fight for their rights. For years, the Act had been holding the students from speaking their minds,” he said.

  6. bayangkan apa akan jadi sekiranya pensyarah dan pelajar berpolitik.. bukankah situasi itu boleh mewujudkan sikap double standard dalam sistem pendidikan kita sekiranya kedua2 kumpulan ini mempunyai haluan politik yang berlainan?

  11. berpolitik kena bataskan juga memandangkan masih bergelar sebagai pelajar. apapun, tanggungjawab sebagai pengundi memang wajib dilaksanakan.

  12. Lebih baik mereka tumpukan kepada pelajaran mereka. Kalau nak berpolitik pun, harus berpadah-padah. Jangan sampai yang dikejar tak dapat, yang dikendong berciciran.

  16. Mungkin ramai yang tidak setuju dengan memberikan kebenaran kepada pelajar Universiti menyertai politik. Apatah lagi ibubapa pelajar.
