Woman claims land lost to Land and Survey staff

KOTA KINABALU June 6, 2012: A 53-year-old Murut Paluan woman of Kampung Tiulon, Sook, yesterday alleged at the Suhakam public inquiry that she lost her ancestral land to three staff of the Land and Survey Department based in Keningau.

Timah Dipal, who was represented by her husband, Yunus Kimin, claimed that she had submitted her application for that piece of land since 1975 which had been passed down to her family by her ancestors.

The application was submitted to the Keningau Land and Survey office and she was later provided with the reference number of PT75130816.

“I received the Notice of Application for Country Land under Section 13 of the Sabah Land Ordinance Cap 68 from the department in Keningau on March 26, 1976.

“On December 4, 1984, I received a letter from the same department requesting me to establish the perimeter of the land and was given between December 14, 1984 and December 28, 1984 to respond. I abided by the directive and established the perimeter,” she said.

However, she claimed that no one from the department ever came to conduct any survey.

In 1988, she again went to the department to enquire into the status of her land application, only to be told to re-apply for the same piece of land because the map submitted in her earlier application was not clear.

“Based on that advice, I re-applied. But I was shocked to be told by officials of the department in 2003 that the same piece of land that I had applied for had been approved and awarded to three people who were unknown to me,” Timah said.

Following their own investigation in 2003, the trio who obtained the land were actually employees of the Keningau Land and Survey office.

She alleged that the trio later sold that piece of land to someone else.
