Man admits to incest, bid to murder stepdaughter
KOTA KINABALU Mac 30, 2012: A Filipino who pleaded guilty at the Sessions Court here to charges of incest, sexual connection by object and attempted murder of his 15-year-old stepdaughter will be sentenced on April 30 this year.
High Court deputy registrar Hafizi Abdul Halim deferred the sentencing of the 34-year-old labourer yesterday pending a report on the mental health of the accused from Mesra Hospital, Bukit Padang.
The plea proceedings yesterday took place in the male ward of the Queen Elizabeth Hospital (QEH) II where the accused was admitted several days ago with an undisclosed illness.
Hafizi also ordered the accused to be referred to Hospital Mesra for psychiatric observation.
In the first charge, the labourer was accused of committing incest with the girl at a riverside in Inanam about 9.30am on March 23 this year.
The charge under Section 376 (3) of the Penal Code carries a jail term of up to 30 years and not less than 10 strokes of the cane.
In the second charge, he was accused of inserting an oil palm frond into the girl’s vagina without her consent at the same time and place.
The charge under Section 377CA of the Penal Code carries a jail term of up to 20 years and whipping.
The Filipino was also accused of attempted murder of the girl by attacking her with the oil palm frond at the same time and place.
The charge under Section 307 of the Penal Code carries a jail term of up to 20 years and a fine.
