LAHAD DATU 20/03/2013: Eight foreigners were charged at a makeshift Magistrate's Court here Wednesday with waging war against the Yang Di-Pertuan Agong.

Two cases under the Penal Code - Section 121 K for waging war against the Agong and Section 130 KA for terrorism - were read to eight Filipinos at the district police headquarters, where the court was set up, at 1pm.

Deputy public prosecutor Mohd Dusuki Mokhtar led the prosecuting team.

The mention was done in the Bajau and Suluk languages.

The case has been transferred to the Tawau High Court.

Earlier, tight security reigned at the police headquarters, where the temporary court was set up to charge those criminally involved in the Feb 12 Sulu armed intrusion at Kampung Tanduo, about 135kms from here.

Attorney-General Tan Sri Abdul Gani Patail arrived in Lahad Datu about noon, while reporters waited at the makeshift courthouse in anticipation of the charges related to police investigations under the Security Offences (Special Measures) Act 2012 (Somsa).

As of Tuesday, a total of 107 people had been arrested under Somsa and some 243 for various other offences under the Immigration and National Registration Acts.

Some were arrested within the Ops Daulat area where security forces launched an air and artillery offensive on March 4 to flush out the terrorists from Kampung Tanduo before they spread towards villages in Tanjung Labian area.

Many others were arrested in Lahad Datu, Semporna, Kunak, Sandakan and other parts of the state.

Eight Filipinos Charged With Waging War Against Yang di-Pertuan Agong

All of them, males aged between 17 and 66, were charged under Section 130KA of the Penal Code for being members of a terrorist group, for which the penalty is life imprisonment, and under Section 121 of the same act for waging war against the Yang di-Pertuan Agong, for which the penalty is death, upon conviction.

Kesemua lelaki itu yang berumur lingkungan 17 hinggga 66 tahun, didakwa mengikut Seksyen 130KA Kanun Keseksaan kerana melancarkan keganasan, yang membawa hukuman penjara seumur hidup, dan Seksyen 121 kanun yang sama kerana melancarkan peperangan terhadap Yang di-Pertuan Agong yang membawa hukuman mati jika sabit kesalahan.
